Conditions générales de venteEQUIPMENT HIRE - TERMS AND CONDITIONS Article 1 : The client assumes total responsability for all equipment taken from the premises. In the case of equipment not returned, in whatever circumstances, the client will be changed the purchase cost of the equipment new less 20% per year of services, plus the hire charges. Article 2 : The equipment is maintained in good condition appropriate for normal use, and should only be used for such purposes. It must be returned in a condition consistent with normal usage. All equipment bears identifying and/or numbers. It must be returned with the same identifying marks and/or numbers. Any deterioration in condition will result in the client bearing the cost of repairs or, in the case of irreparable damage, the purchase cost of the equipment new less 20% per year of service, plus the rental cost. For your own security please tell us if your helmet has sustained a impact. Article 3 : For mountain bike, the problems occuring during the rental (flat tire, breakage, etc …) will be the entire responsability of the renter Article 4 : The hired equipment is to be used only by the client whose name appears on the contract. The equipment must not be re-hired or loaned to a third party. Article 5 : The client can opt to take insurance with the equipment rental. This insurance covers the replacement purchase cost in the event of theft or damage. In the case of theft or damage the client undertakes to pay the excess as stipulated in the contract. The client takes responsability for any other eventualities not covered by this insurance. (Please refer to general conditions of rental displayed in the shop ). Article 6 : The duration of the rental is fixed for the period determinated on the rental contract. The rental period cannot be modified without written confirmation from the rental shop. The rental charges start the day the equipment is taken from and finish the day the equipment is returned to the rental shop. Each rental day is subject to the published tariffs. Article 7 : Proof of identify and/or a credit card imprint may be demanded in order to establish the rental contract. Article 8 : By handing over his credit card informations, the client authorises and gives permission to the shop to charge the appropriated amount to his/her card in settlement of all outstanding debts resulting from unpaid rental charges, missing equipment, or equipment returned and in need of repair (in accordance with the published tariffs). Article 9 : The information requested at the time of rental for the adjustment of the equipment is mandatory. Other informations are optional. You have a right of access, modification, rectification or delection of your personal data as stipulated by article N°34 of the law “Data processing and Liberties” of January 6, 1978 (art. 34 de la loi “Informatique et Libertés” du 6 janvier 1978). To exercise this right, please ask the rental shop. Article 10 : Payment must be received for the hired aquipment at the payment date. Penalities for delayed payment will be applied to the legal interest rate from the time of the formal notice to pay. Article 11 : In case of dispute any relating to this agreement, the competent court will be that of local courts under the code of civil procedure or the court of the place where the consumer lived at the time of conclusion of the occurence of the damaging. Any dispute resulting from the application of the present general conditions of rental will be subject to the French law and the courts in France. The renter agrees with the above conditions as well as the hire rates. To allow this guarantee to be invoked, the customer must: - in case of theft: provide the store, within 24 hours, with the original of the complaint for theft, issued by the gendarmerie or the police. - in case of breakage: return the damaged equipment to the Star-Ski Sports store and it must be recognizable and complete. 3) Loss and disappearance of equipment is not covered. In these cases, the equipment will be invoiced to the customer on the basis of the selling price including VAT of the equipment, minus a percentage of obsolescence of 15% per year. 4) In the event of theft by the customer, misappropriation or any damage to the equipment resulting from non-compliance with the rules of use or regulations in force, or the terms and conditions of this contract, Star-Ski Sports is entitled to exercise a remedy for the entire damage.
